In real estate matters, Don works with clients on mortgage financing, purchases and sales, and prepares development and management agreements as well as commercial real estate leases. In commercial financing transactions, Don has drafted, negotiated and closed sophisticated acquisitions. In banking, he helps financial institutions stay compliant with federal and state regulations. As a corporate attorney, he represents corporations, LLC’s and partnerships with mergers and acquisitions and other restructurings. And, he has counseled clients in sensitive areas of environmental law, including liability and compliance.
Previous to Underberg & Kessler, Don was a Senior Title Officer for First American Title Insurance Company of New York and served as Underwriting Counsel for its wholly owned subsidiary, Public Abstract Corporation. He is a member of the Real Estate Sections of both the Monroe County and New York State Bar Associations, and is a member of the Board of Directors of the Canandaigua YMCA. In addition, Don was Municipal Attorney for the Village of Castorland and the Towns of Denmark, Harrisburg and Pinckney, as well as the Town of Henrietta's Code Enforcement Attorney. He received his B.S. Degree from Cornell University and his J.D. Degree (cum laude) from Tulane University.
