Underberg & Kessler LLP

Someone once said, "Debt is easy to get into, but difficult to get out of." With bankruptcy on the rise in the United States today, more creditors are needing advice and counsel on how to recover debt and avoid bankruptcy discharges. A litigator of complex cases, Bill advises clients on matters relating to bankruptcy, commercial law, and environmental issues. Bill brings to all three areas of practice a commitment to protecting clients' interests and achieving maximum recoverability of assets.

Whether it's securing creditor assets, defending commercial business interests, protecting clients from environmental liability, or advocating for the environment itself, Bill has worked with a wide variety of clients in diverse legal situations. His 20 years of experience includes the avoidance and recovery of fraudulent and preferential transfers, and claims "inherited" by bankruptcy trustees from the debtors whose estates they administer. In commercial law, he has represented an online image developer in a breach of contract suit, the commercial surety for a bankrupt international catalog company retailer and its landlord, and the New York State Insurance Department in a $20 million indemnity case, to name a few. His environmental experience includes having represented municipalities, utilities, publicly traded corporations, family businesses, individuals, and citizen's groups in a wide range of disputes involving hazardous waste, water pollution prevention, petroleum spills, clean air protection, wetlands regulation, and minimizing environmental impact.

Bill is admitted to the New York State Courts and federal courts in the Northeast and Midwest, and is admitted to argue appeals before the US Courts of Appeals for the Second and Sixth Circuits. He received his undergraduate degree from Wittenberg University, and graduated cum laude from Albany Law School of Union University.

In addition to his client work, Bill is active in the community. He is chairman of the Board of Management of the Eastside Family YMCA, and a member of the Corporate Board of the YMCA of Greater Rochester.

With all his clients, Bill brings a nuanced understanding of the law and the commitment to being a tenacious and dedicated advocate for their cause.
