Underberg & Kessler LLP

As a practicing real estate attorney, John has been active in building the community for 35 years. An of counsel attorney in our Real Estate Practice Group and former managing partner, he has counseled developers, lenders and municipalities in every phase of real property finance, development, zoning and land use. But he has also helped build the community in another way—by taking active involvement in its people.

John has helped his clients purchase and develop apartment complexes, shopping centers, and office parks, as well as medical, airport, hotel, manufacturing, and sports facilities. With a focus on real property tax assessment and environmental matters, John has helped clients avoid or manage any pitfalls related to these areas. He has experience in conventional construction and permanent financing as lender's and borrower's counsel and has represented many lenders, commercial developers, municipal and state government agencies, and manufacturers in tax exempt and taxable Industrial Development Agency, HUD financing and other municipal bond financing. He also is general counsel to manufacturing, development and construction companies.

John’s involvement in our community is extensive. He is a recipient of The Daily Record's 2000 Nathaniel Award, awarded to those in the legal profession who have "gone above and beyond the call of duty in the name of justice." John also was the 2010 recipient of the Monroe County Bar Association's Adolph J. Rodenbeck Award, recognizing attorneys who exemplify professionalism and community service.  He serves as chair of McQuaid Jesuit School's Board of Trustees, and is past chair of the Board of Directors and a member of the Executive Committee of the YMCA of Greater Rochester. John is also a member of the Ticor Title Insurance Company’s Advisory Board, former president and director of the Bishop Sheen Ecumenical Housing Foundation, director of St. Bernard’s School of Theology and Ministry, former member of the Board of Directors of NAIOP, a member of the Board of Director’s and corporate counsel of Veterans Outreach Center, Inc., Chairman of Lawyers Concerned for Lawyers and a trustee of the Monroe County Bar Association, and a former trustee of the New York State Lawyer Assistance Trust.

John was selected a 2010 Upstate New York Super Lawyer by Law & Politics. The Super Lawyer group represents the top 5% of attorneys in Upstate New York who have attained a high degree of peer recognition and professional achievement.

John is a graduate of the University of Notre Dame's undergraduate and law schools.
